Data Protection and New Technologies

Data protection and digital governance have become central issues for private companies, public authorities and start-ups in a context of rapid technological transformation. This field notably covers compliance with data protection regulations (Swiss FADP and GDPR), cybersecurity, as well as legal issues related to artificial intelligence, machine learning, automation and data-driven models.

Our firm advises digital businesses, IT service providers, public institutions and innovative start-ups facing legal, operational or ethical challenges arising from the use of advanced technologies. We assist in the compliance of data processing activities, the development of digital governance strategies and the drafting of internal policies, in particular in relation to artificial intelligence and privacy by design.

We support our clients in the legal framework governing AI systems, the drafting and negotiation of technology contracts (SaaS, cloud services, licences, data processing agreements), as well as in the management of security incidents, cyberattacks and data breaches, including notifications to authorities and affected individuals.

We also accompany start-ups and technology companies at every stage of their development, from conception and market entry to growth. Our work includes the legal structuring of technological products and solutions, the protection of intellectual property relating to software, algorithms and databases, as well as assistance with fundraising rounds, investment agreements and corporate transformations. This approach is based on combined expertise in business law and new technologies, in support of innovation in Switzerland and internationally.

The added value of our specialised lawyers lies in their in-depth expertise in data protection, new technologies law and AI regulation, enabling us to provide advice that is strategic, practical and tailored to technical realities. We regularly assist with FADP/GDPR audits, data protection impact assessments (DPIAs), proceedings before the competent authorities and the governance of AI systems, including requirements relating to transparency, risk management and bias mitigation.
